Capital Value Tax on Real Estate Related Transactions in Pakistan

The Capital Value Tax is applicable in urban areas for residential property exceeding an area of one kanal and in case of commercial properties without any threshold of land area or size of the property.

The Capital value tax at the rate of 2 percent of recorded value has been levied vide Finance Act, 2006.

Where the value of such property is not recorded, the CVT is payable at Rs. 50 per square yard of land area.

All transfers falling under the scope of purchase, gift, exchange, surrender, power of attorney and relinquishing the rights have been subjected to the capital value tax. However, transactions between spouses, parents, grand parents, brothers and sisters through gift and inheritance have been excluded from its purview.

How foreigners can invest in Pakistan real estate

Foreigners living in Pakistan could be discouraged to rent or buy property here in the sense that a little bit lengthy and lethargic process which can take several months to complete.   5. Last but not the least, the law requires a contract to be drafted in the name of the occupant of the property. In case, a new tenant occupies the property, he’s legally required to get a new contract otherwise strict legal action would be taken against him.

Violation of the above mentioned procedure may lead to prosecution of the tenant, the landlord or both.

The whole of this process is daunting to say the least and keeps foreigners from investing in Pakistan real estate. The refusal on part of government to let foreigners freely buy and sell property in Pakistan is due to security concerns.

Application for registration of a patent in Pakistan

The Patent law of Pakistan requires every application for the patent to be on the prescribed form and to contain a declaration to the effect that the applicant is in possession of an invention of which he, or in the case of joint application, at least one of the applicants, claims to be the true and the first inventor. As per Pakistani law each application to be in respect of one invention only or to be in respect of a group of inventions so linked as to form a single inventive concept. Complete or provisional specifications are required to accompany the application. Every complete specification is required,-

      (a) to fully and particularly describe the invention and the method by which it is to be performed;

(b) disclose the invention; and

(c) end with a claim or claims defining the scope of the invention for which protection is claimed.

The claim or claims of a complete specification are required to relate to a single invention, to be clear and succinct and to be fairly based on the matter disclosed in the specification. An abstract is also required to be furnished.

The new law requires each application to be accepted or refused in eighteen months (or twenty-one months, in case an application for extension of time is filed) from the date of the filing. Once accepted, each application will be open for opposition for four months from the date of its publication in the Gazette.

Section 20 of the Patent law empowers the Controller to require foreign applicants to furnish date and number of any application for patent filed by the foreign applicant abroad relating to the same or essentially the same invention as that claimed in the application filed in Pakistan. The applicant, when required by the Controller, is required to furnish with the following documents relating to foreign application(s),-

      (a) a copy of any communication received by the applicant concerning the result of any search or examination carried out in respect of the foreign application(s);

(b) a copy of the patent granted on the basis of the foreign application(s); and

(c) a copy of any final decision rejecting the foreign application(s).

Infringement of Patent in Pakistan

Infringment of Patent in Pakistan, Section 61 of the law lists reliefs that a Court may grant in suits for infringements. These include,-

    • (a) to order to desist from infringement,

(b) to prevent the entry into the channels of commerce of imported goods that involve the infringement immediately after custom clearance of such goods;

(c) to order the infringer to pay the right holder damages adequate to compensate for the injury he has suffered because of infringement;

(d) to pay the right holder expenses which may include appropriate attorney’s fee;

(e) in appropriate cases, to order recovery of profits, damages and pre-established damages even where the infringer did not knowingly or with reasonable ground to know, engage in infringing;

(f) to order that goods found to be infringed be, without compensation of any sought, disposed off outside the channels of commerce;

(g) to order the material and implements the predominant use of which has been in the creating of infringing goods be, without compensation of any sought, disposed off outside the channels of commerce in such a manner as to minimize risk of further infringement, and in considering such orders, the need for proportionality between seriousness of infringement and remedies ordered as well as interests of third parties shall be taken into account;

(h) unless this would be out of proportion to the seriousness of the infringement, to order infringer to inform the right holder of the identity of third parties involved in the production and distribution of the infringing goods and of their channels of commerce; and

(i) to order a party at whose request measures were taken and who has abused enforcement procedure, to provide to a party wrongfully enjoined or restrained, adequate compensation for injury suffered because of such abuse.

The Court is also granted powers to order prompt and effective provisional measures.

Dischonour of Cheque

Dischonour of Cheque

Defination of “dishonoured cheque”, which when presented in the Bank same is refused of payment by the bank because of insufficient funds or it is not in order, it is called dishonestly issuing a cheque is a criminal offence in Pakistan. Dishonestly issuing a cheque is governed by section 489-F of the Pakistan Penal Code, 1860. The said section reads as follows:

489-F Dishonestly issuing a cheque: Whoever dishonestly issues a cheque towards re-payment of a loan or fulfillment of an obligation which is dishonoured on presentation shall be punishable with imprisonment which may extend to three years and with fine unless he can establish, for which the burden of proof shall rest on him, that he had made arrangements with his bank to ensure that the cheque would be honoured and that the bank was at fault in not honouring the cheque.

The offence under this section is cognizable by police, non-bailable and compoundable.
