Preparation of Divorce papers in Karachi Pakistan

If Husband is seeking to give divorce to his wife or on the other hand if a wife is seeking to exercise her delegated right of divorce in her nikhanama, then Divorce papers are prepared by the Lawyers. If both parties agree to divorce each other then a mutual divorce deed is prepared, whereas it is commonly one sided. A Divorce Deed is prepared wherein a brief history of marriage and child description is narrated, which is supplemented with terms and conditions of divorce if any. It is also mentioned that the amount of Haq Meher is returned by way of a cheque/ Pay order and the same is tendered along with original Divorce Papers. The Divorce Deed is couriered to the recipient and it is ensured that the same is received.

A Copy of the Divorce Deed along with copy of the cheque and delivery receipt of the courier is submitted before the concerned union council which upon receiving application will issue notices to the parties for reconciliation.  The Applicant can appoint their lawyer to appear on their behalf who will attend hearing for reconciliation. If reconciliation fails then the concerned union council issues divorce certificate.

Q. Can husband and wife dissolve their marriage through mutual consent?
A: Yes, they can dissolve their marriage through mutual agreement; the said divorce is called Talaq-e-Mubarat, literal meaning of Mubarat is ‘obtaining release from each other’. The offer for separation in Mubarat may proceed either from the wife or from the husband and as soon as it is accepted dissolution is complete.

Q: Whereabouts of my husband are not known for a long time can I end my marriage?
A: Yes, you can end this marriage under the Dissolution of Muslim Marriage Act 1939 if whereabouts of your husband are not known for a period of four years.

Sindh High Court stays suspension of Teachers of Education Department.

The Sindh High Court (SHC) suspended the education department’s notification regarding the suspension of a large number of teaching and non-teaching staff from Nausheroferoz district.

The interim order came on the petition of many staff members of District Nausheroferoze , who assailed the notification regarding their suspension from jobs by the Secretary Education in the month of November 2014.

It was submitted by us Petitioner’s counsel ( Mr. Irfan Mir Halepota ) that  the petitioners were appointed in the education department from 1989 to 2010 and they were performing their duties in different posts.

The counsel submitted that the Education Department issued a notification whereby the services of a large number of teaching and non-teaching staff, including the petitioners, from several districts of the province were suspended without assigning any reasons and they were ordered to report to the department with immediate effect without any justification or allegation against them.

He submitted that neither any inquiry was conducted nor any opportunity was provided to the petitioners to explain the allegations. He submitted that the notification was based on mala fide intention, and prayed the court to set aside the impugned notification.

After the preliminary hearing, the division bench issued notices to the Sindh advocate general and secretary education among others, calling their comments.

The Honourable court also ordered that the notification shall remain suspended till the next date of hearing.
